Moderator: Herb Chasan presented a motion just before we went home last Thursday. Reconsideration has been made. Notice has appeared in the local paper. I recognize Mr. Chasan. |
Tuesday May 15, 2012 7:38 |
| 7:39 |
|
Moderator: Before, we voted not to take up article 41 on Tues., May 22. Mr. Chasan wants reconsideration of that motion. We will take a vote on reconsideration. Each person who wishes to speak on the topic can speak for 3 minutes. |

Moderator: Meeting called to order. I recognize Herb Chasan. |
Tuesday May 15, 2012 7:40 |

|
TMM4 Herb Chasan: The leaf blower motion was made in haste. There was no discussion. Why was this motion made and what was the rationale? Please vote yes for reconsideration. |
Tuesday May 15, 2012 7:41 |
| 7:43 |
|
Edward Cross TMM12: It made sense to me. Urge you not to reconsider. |
Tuesday May 15, 2012 7:43 |
| 7:44 |
|
TMM7 Kevin Crotty: I support reconsideration. It was done at the end of the night. |
Tuesday May 15, 2012 7:44 |
| 7:46 |
|
TMM12: Mark McClennen: One of the reasons motion was made was Ways & Means committee was dissolved. This is for continuity's sake. That being said, I also kind of support reconsideration. There's a lot of passion going on around leaf blower issue. We postponed the wrong article; we should postpone the leaf blower article. |
Tuesday May 15, 2012 7:46 |

Town Counsel: It's routine that votes happen before meetings. Should be a legal vote. |
Tuesday May 15, 2012 7:48 |
| 7:49 |

Tuesday May 15, 2012 7:49 |

|
Moderator: It was my feeling this was not a motion for table. |
Tuesday May 15, 2012 7:49 |
| 7:51 |
|
TMM7 Joel Winett This particular article was chosen to give clarity to the citizen. Would like to differ with Town Counsel. Standing committee took a vote: if town meeting were to dissolve before next Tues., a new standing committee would have to meet to make a recommendation to town meeting. |
Tuesday May 15, 2012 7:51 |
| 7:53 |
|
TMM Levarge: What will happen with article 41 if reconsideration prevails? |
Tuesday May 15, 2012 7:53 |
| 7:56 |
|
Precinct 10 ways and means member: I had no idea that motion was made until Friday when I got a phone call. There's no way of knowing there was a quorum. It looks like a split vote. |
Tuesday May 15, 2012 7:56 |
| 7:57 |
|
Moderator: Under the circumstances, I let the motion go forward. I tried to keep people here. I asked if there was any discussion, saw no hands. There was no motion made for quorum called. |
Tuesday May 15, 2012 7:57 |

Tuesday May 15, 2012 8:16 |
| 8:18 |
|
Giombetti: RFP on review of assessor work has gone out and they are about to start. Senior abatement discount is second. Third is early warning - we had two meetings and hope to make recommendation to full board next month. |
Tuesday May 15, 2012 8:18 |
| 8:20 |
|
Giombetti: Fourth is business-friendliness of town. Will be first meeting with consultant next week. Don't recall last two, but will report later if remember. But we are working diligently on each of the 6 issues. |

[Comment From JR JR : ] The Constitution under the Bill of Rights mentions the right to Petition and assembly It is a CONSTITUTIONAL RIGHT going back to the Bill of english rights of 1689. The right to petition is also a right at a decent hour to petition our Government. not at a haphazard way the Selectmen want it now. Please go with our Constitution |

TMM3 Audrey Hall, chair of ways & means committee: operating funds broken out by building, one building stands out - the Athenea building on Concrod St. in Saxonville. What would it take to maintain and make usable? Move that town manager look into what it would take to get an occupancy permit for Athenea Hall. |
Tuesday May 15, 2012 8:26 |
| 8:28 |
|
TMM2 David Longden: Friends of Saxonville concerned with Athenaeum Hall. Served many purposes. Closed in 1995. Town's admin made a promise that, once repairs were done, could continue to use for meetings. That was 17 years ago and building is still not in condition to reopen. |
Tuesday May 15, 2012 8:28 |
| 8:30 |
|
Longden: Roof, column repairs have been made thanks to town and grants. In 2010, town meeting directed town manager to create a plan to reopen. Town has not spent any money on building since 1995 except $200 annually on electricity. Not asking for money now, but perhaps in the fall. Only ask for a plan to move forward. |
Tuesday May 15, 2012 8:30 |
| 8:32 |
|
TMM2 Melanie L. Goddard: Looking for explanation for increase in numbers. |
Tuesday May 15, 2012 8:32 |
| 8:34 |
|
CFO: Salary line item for service department - part-time and full-time salaries have changed, funded 2 more part-time positions instead of retirement. Dollar value isn't as much as it looks like because they offset each other somewhat. |
Tuesday May 15, 2012 8:34 |
| 8:34 |
|
Budget committee director - approved budget. |
Tuesday May 15, 2012 8:34 |
| 8:36 |
|
TMM10 Kathleen McCarthy: Understand Friends of Saxonville. There are a lot of buildings, and should be a report on our various buildings and where they all stand. |
Tuesday May 15, 2012 8:36 |
| 8:37 |
|
TMM: Move the question. Moderator: Hand vote. Question moved. |

Tuesday May 15, 2012 8:43 |
| 8:44 |
|
CFO - Finance classification - finance committee, CFO (pass), counting dept., assessing dept (pass), treasurer/collection dept. Total $1.9 million |
Tuesday May 15, 2012 8:44 |
| 8:44 |
|
Moderator: Are there committee reports? Seeing none, who wishes to speak? |
Tuesday May 15, 2012 8:44 |
| 8:46 |
|
TMM3 Hall: Committee report on ways & means - discussed finance committee budget, reviewed requests for new positions in assessor's office. Committee recommends that only one person (not two) FTEs be hired. |
Tuesday May 15, 2012 8:46 |
| 8:48 |
|
TMM2 Harold Geller: Salary has gone up - is this the difference between funded and unfunded positions? |
Tuesday May 15, 2012 8:48 |
| 8:48 |
|
CFO: We added a position partway through 2012 for financial analyst, and that postion is fully funded for the next fiscal year. |
Tuesday May 15, 2012 8:48 |
| 8:49 |
|
Geller: If more information added to line items, it would be very instructional. Looks like we're in the process of hiring consultant for assessing. |
Tuesday May 15, 2012 8:49 |
| 8:49 |
|
CFO: Consulting contract is under Board of Selectmen budget for FY2012. |
Tuesday May 15, 2012 8:49 |
| 8:49 |
|
Geller: Didn't see a line item covering that. |
Tuesday May 15, 2012 8:49 |
| 8:50 |
|
CFO: Begins this fiscal year, may not be completed, but majority will be done in this fiscal year. Was added to BoS budget in previous town meeting. |
Tuesday May 15, 2012 8:50 |
| 8:52 |
|
TMM7 Joel Winett: Move that the CFO provide report at 2012 fall town meeting. For each special account for non-grant revenue received by non-departments. For contributions received for special purposes, total amount accumulated over many years but not yet expended. |
Tuesday May 15, 2012 8:52 |
| 8:54 |
|
Moderator: TMMs wish to comment on CFO? |
Tuesday May 15, 2012 8:54 |
| 8:55 |
|
Finance committee: Executive summary by CFO is pretty clear about positions. |
Tuesday May 15, 2012 8:55 |
| 8:56 |
|
CFO: This goes to a handful of particular items not included in previous resolutions. Edgell Cemetery is actually a trust fund. Probably no more than $300k for everything listed in first part of motion. Not quite sure about what contributions to special purposes means. |
Tuesday May 15, 2012 8:56 |
| 8:57 |
|
Winett: contributions to special purposes refers to funds town may receive for designated purposes that the town treasurer may be holder of funds but they're not spent through the budgetary process. |
Tuesday May 15, 2012 8:57 |
| 9:00 |
|
Lampell: Vice chair of finance committee: May 9 vote 5-4 that board of selectmen should return some money from state aid to taxpayers to reduce tax levy. |
Tuesday May 15, 2012 9:00 |
| 9:01 |
|
TMM7 Crotty: It's like pulling teeth to get information out of assessor's office. Maybe they need more personnel, but lately have been running the place with cavalier attitude. |
Tuesday May 15, 2012 9:01 |
| 9:02 |
|
TMM1 Ted Anthony - point of information - last couple of votes have been hand count. Would like to ask that we have a recorded vote on taxes. |
Tuesday May 15, 2012 9:02 |
| 9:03 |
|
Mulvey: Assessing report was given on first town meeting night. |
Tuesday May 15, 2012 9:03 |
| 9:04 |
|
TMM18 George Lewis: Article 10 listed everything included for abatement info for annual report. Previous speaker said two items not included in report. Disagree- there were 6 items not included. |
Tuesday May 15, 2012 9:04 |
| 9:06 |
|
Lewis: Most egregious concern I have is our chief assessor ignored items required in annual report. |
Tuesday May 15, 2012 9:06 |
| 9:08 |
|
Town Counsel Petrini: AG did approve article 10, but said assessor has to be careful about listing reasons for abatement. |
Tuesday May 15, 2012 9:08 |
| 9:09 |
|
TMM2 Gloria Geller: What concerned me most was difference between assessed values and selling prices. |
Tuesday May 15, 2012 9:09 |
| 9:11 |
|
CFO: Our chief assessor is certified and well-respected in the assessing community, by the dept. of revenue, and he does a good job. We follow dept. of revenue policies and procedures. We follow same process every other MA community follows. |
Tuesday May 15, 2012 9:11 |
| 9:13 |
|
CFO: We have 3 field assessors, one chief assessor, etc. We have a board that meets once/week to review all properties in town. We have to review all properties within 6 years (instead of previous 9 years). This will require additional staff. People have called for more physical review, more followup. That's what is intended with an additional field assessor. Addition of a customer service rep is so we don't have to bring on field assessor to supplement customer service. |
Tuesday May 15, 2012 9:13 |
| 9:15 |
|
CFO; If you want a more thorough process, you're going to have to have staff to do it. Also added commercial assessment consultant. Added more to appellate lawyer to protect town from commercial appeals that happen on a regular basis. |
Tuesday May 15, 2012 9:15 |
| 9:16 |
|
TMM1 Teri S. Banerjee - there should be majority/minority votes. |
Tuesday May 15, 2012 9:16 |
| 9:17 |
|
Moderator: We don't give specifics except for vote count. |
Tuesday May 15, 2012 9:17 |
| 9:17 |
|
Banerjee: Referring to vote on resolution of 5-4. Would like pros and cons on that. |
Tuesday May 15, 2012 9:17 |
| 9:17 |
|
Moderator: I don't want to get into majority/minority votes. We'll be here till Christmas. |
Tuesday May 15, 2012 9:17 |
| 9:18 |
|
[Comment From Guest Guest : ] Where are we on the agenda as far as the school budget....any chance it comes up tonight? |
Tuesday May 15, 2012 9:18 Guest |
| 9:18 |
|
[Editor note - school budget discussion looks unlikely at the moment] |
Tuesday May 15, 2012 9:18 |
| 9:20 |
|
TMM Schmeidler: Does CFO hold herself fully accountable for what has occurred? |
Tuesday May 15, 2012 9:20 |
| 9:21 |
|
Moderator : I'll allow it. [Discussion between moderator and Kelly] Ms Kelly, the question was directed to you. [Kelley doesn't go to mic.] Let's take a 10 minute break. |
Tuesday May 15, 2012 9:21 |
| 9:31 |
|
Moderator: Town meeting will now resume. Please take your seats. Quiet in the hall. |
Tuesday May 15, 2012 9:31 |
| 9:32 |
|
Moderator: Let's go back to the last comment by TMM - that's attacking someone's character, in my opinion. There is no room for that kind of conduct. Ms. Kelly does not have to defend herself. Last speaker's comments will not be given any credence. |
Tuesday May 15, 2012 9:32 |
| 9:32 |
|
[Smattering of applause.] |
Tuesday May 15, 2012 9:32 |
| 9:33 |
|
Moderator: We are talking about assessing line item. To move the question, a 2/3 vote is required. Hand vote. |
Tuesday May 15, 2012 9:33 |
| 9:34 |
|
TMM4 Schmeidler: Point of order - I made my question as a town meeting member based on corporate experience. |
Tuesday May 15, 2012 9:34 |
| 9:35 |
|
Schmeidler: Based on corporate officer and military officer, rests with command. I did not make a character attack. |
Tuesday May 15, 2012 9:35 |
| 9:35 |
|
Moderator: We are not a corporation or military. Moving on. |
Tuesday May 15, 2012 9:35 |
| 9:36 |
|
Moderator: Assessing line discussion is stopped. We will move to Ms. Hall's motion on ways & means - request 2 add'l full-time in assessing budget be changed to 1 fulll-time. We're going to do the vote with machines. |
Tuesday May 15, 2012 9:36 |
| 9:38 |
|
Reduce assessors vote: Yes 55, No 63, Abstain 10. Motion fails. |
Tuesday May 15, 2012 9:38 |

Yes 97, No 26, Abstain 7. Motion passes. |
Tuesday May 15, 2012 9:43 |
| 9:45 |
|
Moderator: Move to resolution offered by finance committee: that assessor and CFO provide information about potential to reduce taxpayer levy. |
Tuesday May 15, 2012 9:45 |
| 9:45 |
|
TMM Goddard: Would like to hear CFO position on resolution. |
Tuesday May 15, 2012 9:45 |
| 9:47 |
|
CFO: This resolution would advise the selectmen in the tax setting process if we did receive additional state aid or additional receipts, that we could increase the non-tax portion of the revenue for the budget and reduce the tax levy portion. Generally this doesn't happen frequently.. It would have to be new state aid after town meeting or some bonus payment after the fall town meeting. Otherwise, any changes would be handled at fall town meeting. |
Tuesday May 15, 2012 9:47 |
| 9:47 |
|
CFO: It would be a rare occasion, but I'm not opposed. |
Tuesday May 15, 2012 9:47 |
| 9:48 |
|
TMM4 Adam Steiner: This reads like a political argument. Language is imprecise. |
Tuesday May 15, 2012 9:48 |
| 9:50 |
|
TMM5 Bob Boise: Like to know the outcome of using free cash to reduce tax levy. How often done? |
Tuesday May 15, 2012 9:50 |
| 9:51 |
|
CFO: Used right in this budget. We have a policy to use $1.5 mill every year to reduce tax levy. |
Tuesday May 15, 2012 9:51 |
| 9:51 |
|
Question is moved. Electronic voting now. |
Tuesday May 15, 2012 9:51 |
| 9:53 |

Finance Committee Resolution: Yes 91, No 31, Abstain 6. Motion passes. |
Tuesday May 15, 2012 9:53 |

|
Moderator - Move now to next classification - inspection services. |
Tuesday May 15, 2012 9:53 |

|
Paulsen: I have a different number of items. |
Tuesday May 15, 2012 9:54 |

|
CFO: Inspectional services: $836k. |
Tuesday May 15, 2012 9:55 |
| 9:55 |
|
Moderator: I heard one pass. |
Tuesday May 15, 2012 9:55 |
| 9:56 |
|
Cathy McCarthy: Committee report on public safety. Met with building inspector dept. Comprehensive assessment. Voted to support CFO's budget 5-0-0. |
Tuesday May 15, 2012 9:56 |
| 9:56 |
|
Moderator: Will open up for comment. |
Tuesday May 15, 2012 9:56 |
| 9:57 |
|
TMM10 Bill McCarthy: Are we still paying salary for building inspector? Can we get an update? |
Tuesday May 15, 2012 9:57 |
| 9:57 |
|
Mulvey: Yes, building commissioner getting paid full salary at this time. |
Tuesday May 15, 2012 9:57 |
| 9:59 |
|
Town Counsel: District attorney continues to review matter. Under MA law, there's a right of due process before you can take away wages. Decided it would be better to investigate as a criminal matter. Don't want two proceedings at once. |
Tuesday May 15, 2012 9:59 |
| 9:59 |
|
Town Counsel: Hope to have a decision made soon. Know it's not a popular one, but it's the right legal thing to do. |
Tuesday May 15, 2012 9:59 |

Editor's Note: Just want to say thanks to freelancer writer Tiffany Reevoir for filling in for me live blogging at Night 10 of Town Meeting. I'll be back live blogging on Night 11.
And for those texting and emailing - Night 11 - could be the night for the school budget discussion and vote (and thus the yes for tuition free full-day kindergarten.)
Feel free to join Framingham Patch (and me) at Town Meeting tomorrow night, May 16 in Nevins Hall |

It's the selectmens job to hold the CFO accountable. The CFO already explained what happened. It's up to selectmen to decide what the consequences should or shouldn't be. Mr. Schmeidlers concern should be directed to the BOS.

The town's handling the Michael Foley case should be ashamed!
He should of been fired and let him come after the town.
Just the fact that he treated a few residents badly is enough reason to can him.
There is more to this story than is being told and they are taking all this time to figure out how to get out of it.
The "Good Ole" boys network is working just fine in Framingham.
Enough is enough on this on!

Jim: As a taxpayer and a resident, my preference would have been for him to be placed on UNPAID leave and if the charges or issues against him turned out to be false, then he could have all of his pay back in one lump sum.
(I should note that I have not written any of the articles on Michael, that a couple of the freelancers have covered those hearings/meetings.)

Unpaid leave would of been way better than what is going on now.
