UPDATED: Police: Man Tries to Drown Another at Pond For Cell Phone, Nike Sneakers

Framingham Police arrested two men Tuesday after a third man said they tried to rob him for his cell phone and one tried to drown him in Learned's Pond.

Framingham Police arrested two men Tuesday after a third man said they tried to rob him for his cell phone and one tried to drown him in Learned's Pond.

The victim, a man, 34, said  two men stole his Nike sneakers and his cellphone and that one of the two men held his head underwater at the pond and tried to drown him around 5 p.m. Tuesday.

Police arrested Carlos Fuerte, 29, and Sergio Polanco, 36, both of Framingham.

When Framingham Police arrived they found two men, including the victim.

The victim told Police he was in the woods with two of his friends at the rope swing, which is in the wooded area next to Learned's Pond, according to the police report.

The victim told told Police the two friends left and shortly thereafter he went to get his belongings. The victim told police the two men then confronted him and tried to take his cell phone. 

The victim told Police a fight started and they ended up in Learned's Pond.  

The victim told Police Fuerte, who lives at 48 Berry St., was "forcibly pushing his head under the water and trying to drown him."

The victim said the fight lasted about 5 minutes and the two males took off towards Learned's Beach through the woods.  

The victim said the two men stole his LG cell phone and his Nike sneakers.   

Police found Polanco carrying a orange bag with various items, said Framingham Police Lt. Ron Brandolini. Upon a search of Polanco, the Nike sneakers described stolen were found, said Brandolini.

The victim said Polanco did not assault him.  

A second Framingham Police officer found Fuerte in the woods where the robbery occurred, according to the police report.

The victim  immediately identified him as the person who assaulted him and stole his belongings, said Brandolini.

The police officer said Fuerte immediately took a cell phone out his pocket and handed it to the police officer. The victim identified it as his phone.

Police charged Fuerte with attempted murder, unarmed robbery and assault and battery with a dangerous weapon.

Polanco, who lives at 4 Beaver Park Road, was charged with unarmed robbery.

There are immigration detainers on both, for being in the United States illegally from El Salvador. There were two warrants on Fuerte, according to Framingham Police.
