Woman Charged with Throwing a Rock at A Toddler Held Without Bail

Police arrested a 43 year old Framingham woman for assault with a deadly weapon and probation violation on Aug. 2.

A confrontation at CAP auto parts in Framingham resulted in police charging a 43-year-old Framingham woman with assault with a deadly weapon among other charges on Aug. 2.

Susan Fogerty, of 40 Mellen St., Apt. 3, was charged with assault with a deadly weapon (a rock), three charges of disturbing the peace and disorderly conduct on Aug. 2 at 7 p.m. on Waverly St. She was also on probation for a drunk driving charge, according to a police report. 

According to police, Fogerty threw a rock at a two-year-old toddler in a car after confronting the toddler’s mother. Fogerty allegedly accused the mother of having an affair with Fogerty’s husband.

Fogerty was “screaming and flailing her arms,” according to the report before picking up a rock and hurling it at the rear window of the victim’s car, missing the two-year-old sitting in the back.

According to police, Fogerty appeared intoxicated at the scene and officers could smell alcohol on her breath. Fogerty also knocked down a display over in CAP auto parts and “made a mess” of the store.

At the scene, Fogerty claimed she didn’t know there was a child in the back seat of the car because the sun was in her eyes, and she denied throwing anything, according to police.

Police reported Fogerty remained “verbally combative” after her arrest. At her arraignment on Aug. 5, she was released on personal recognizance for the new charges. Because of her probation violation however, she is automatically held without bail, as ordered by Judge Robert Greco. She will appear back in court on Aug. 16 for a pre-trial conference.
