Abutters Maintain Ellingwood is a Serious Health Threat

Framingham Board of Health is waiting for answers and action from DEP before it moves ahead on what to do with Ellingwood Construction.

Members of the working group looking into possible illegal and health-related issues swirling around activities of at its site in north Framingham reported limited progress in resolving a myriad of issues before the Board of Selectmen Tuesday night.

Director Ethan Mascoop told Selectmen the state Department of Environmental Protection (DEP) has not adequately addressed some of the concerns of the working group and until they get some answers, there is very little the Board of Health can do to alleviate the situation.

But Health Board member Mike Hugo assured the selectmen the Board of Health will work on the issues once it is clear what DEP can and will do. “DEP can only do this much,” said Hugo, holding his outstretched hand about waist high. “The town wants this much,” as he raised his other hand over his head. Hugo then said the Health Board will take over where DEP’s actions stop and work to resolve all the issues the town has with the Ellingwood site.

Framingham’s Health Board has joint jurisdiction with DEP on the Ellingwood matter but has to play a secondary role because as a state agency, DEP calls the shots.

The central issue center around what DEP allows Ellingwood to bring onto the property.

According to a DEP issued Determination of Need, Ellingwood may accept clean, uncontaminated asphalt, brick and concrete at its site for eventual processing for customers.

Neighbors living close to the site maintain that Ellingwood’s operation may pose a serious health threat. They say processing asphalt, concrete and brink causes hazardous dust, unwelcome noise from heavy machinery, unlawful dump truck traffic on residential roads and violations of various zoning laws.

To combat the dust and noise situations, DEP ordered Ellingwood last fall to build a protective berm to shield other property owners in the area. Questions arose whether Ellingwood has actually built a berm and members of the working group were asked to look into the matter.

Apparently, Ellingwood was dumping soil and possibly other construction materials on land the company did not own and which was designated for a planned unit development many years ago.

Selectmen asked the working group to return and present an update on progress at the Feb. 28 meeting.

Is there any one in this working group representing Ellingwood Construction. They have tried to build a protective berm to shield other property owners in the area. However Tunisio denied the permit to build it, so what is the Company to do. They had this business for many years prior to this folks buying their homes around them, sice when do we penalize success.

They shouldn't of been given the permit to be there in the first place. The land wasn't zoned for that right from the beginning. Why all thee fuss? I can't understand all the other extemporaneous stuff being said here.....No matter what is going on there now, they weren't supposed to be working there like they are from the beginning. Against my better judgment I will answer you JIm, Ellingwood Construction got their permit the year you graduated from high school. You should have stick to hocky playing you weren't that bad and stay away from jumping over fire with a Superman cape :)

Cesar....So giving me an answer is against your better judgment....interesting?? I still don't understand your point? They shouldn't of even been given that permit. What Ellingwood is doing there is not what the site was supposed to used for. And finally....what does hockey playing have to do with this? And the comment about the fire and superman cape is pretty heartless....as my brother almost died at the tender age of 5 for doing that. Maybe you find humor in things like that I surely don't. Is he telling the truth? Dunno .. we found him lying about other stuff right on this site. There's no going back on the zoning a million years ago. The town uses permits as a revenue stream. How about provide some guidance on how the berm should be constructed and let them get back to work.

Kim, I need your advice--is it pointless? Is it cruel, perhaps, to continue such a discussion? I don't want to be cruel, and so your input here would be helpful. But I'm truly torn. If someone--or two people-- stand in the public square and scream obscenities about other people, what is the proper reaction of a decent person? Do you simply ignore them? Do you argue to influence them? Do you try to help them? If so, when do you give up? The Rizolis--who have shown themselves to be extremely limited in every sense--say I am obsessed. With improving things I AM obsessed! And not ashamed. I first started writing on The Patch the way other people take up crossword puzzles--to exercise my mind, in a way. But it has brought me face to face with my greatest fear: ignorance that has no concept of ignorance, nor of its own potential to set back the world. Sorry to bother you with all of this!

David - I understand your dilemma, truly. Under normal circumstances, I would try to help the person displaying the aberrant behavior, but in this instance, I think it's best to simply ignore. I understand what you mean, as I'm often drawn to some of the comments simply because I find them both frightening and unbelievable, and I'm compelled to respond. I honestly lose sleep over some of the things I read. But nothing is going to change the behavior you’re seeing. The armchair psychologist in me says it simply must be NPD, so the best we can do is distance from it. I would hate to see you stop commenting, as you are thoughtful, insightful, intelligent and humane. So many people who post have important things to say, and viewpoints to share that enrich the minds of the rest of us. We can’t change other people, we can only change our reactions to them, right? What do you think?

@Jim -- that is my job and you went far off topic long before David! At this point, I will offer my advice David. I, like Kim, tried to reason; but there are limits. Some people do not have the capacity to understand reason. They only hear what they are preaching. Like a parent, sometimes it is important to try to teach a lesson - provide insight, facts and logic - and sometimes when a child is having a tantrum best and screaming so loud they can NOT listen it is best to ignore .. and move on.
